Retrospective Commercial Application – London Borough of Hounslow

We were approached after our client received an Enforcement letter from Hounslow Council which stated that there was a material change of use without planning permission.
We advised that a retrospective application should be submitted to the council as the works had already started. Additionally the Council also required a Noise Impact Assessment so we advised the client to instruct noise assessors to carry out the evaluation. The local area is residential and the noise assessment would identify the impact of noise from the shisha lounge and its effects on the surrounding area.
Hounslow council approved the application on the grounds that there would be no adverse affect on the surrounding area. However there was a condition which stated that the outside smoking amenity area should not be occupied outside the hours of 10am to 11pm Monday to Sunday and bank holidays.
