Our client occupies an apartment on the top floor of a mansion block in the Royal Borough of Kensington and Chelsea. They originally applied to use a flat roof area as a roof terrace, however, the application was turned down on the grounds of creating noise and disturbance to the detriment of neighbouring residents. We were instructed to reverse the Council’s decision and set about preparing revised drawings and a Planning Statement to address the previous reasons for refusal. The proposal attracted fresh objections and was referred to Planning Committee. Notwithstanding this, the proposal was approved and our client can now construct a significant roof terrace.
